Ooma’s Hispanic Heritage Month Giveaway Official Rules

IF YOU DO NOT AGREE TO THESE OFFICIAL RULES, DO NOT ENTER THE SWEEPSTAKES.

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

Eligibility: Open to legal residents of the 50 United States including the District of Columbia who are 18 years of age or older at time of entry. Employees and their immediate family members (parents, siblings, children and spouse, and any person residing in the same household whether related or not) of Ooma, Inc. (“Sponsor”), and its affiliated companies and subsidiaries, and their advertising and promotion agencies associated with Ooma’s Hispanic Heritage Month Giveaway (the “Sweepstakes”), and their respective agents, officers, and directors, and all individuals, including, but not limited to, consultants, independent contractors, temporary or contract employees, former employees and interns, and their immediate family members who within the past six months have performed services for Sponsor are not eligible to enter or win.
Sweepstakes Period: The Sweepstakes begins at 9:00 a.m. PST on Thursday, September 15, 2022, and ends at 8:30 p.m. PST on Saturday, October 15, 2022 (the “Sweepstakes Period”).
How to Enter: You can enter for free by following these instructions during the Sweepstakes Period. Visit Ooma Business’ Facebook page at https://www.facebook.com/OomaBusiness/ and locate the Hispanic Heritage Month promotional post inviting you to take part in the Sweepstakes. “Like” the post to enter the contest. There is a limit of one entry per participant. Receipt of entry will not be acknowledged. Alternatively, you can enter by mailing a written request to Sponsor at the address below. Any mailed entries must be received by Sponsor before the end of the Sweepstakes Period.
How to Win: One winner (the “Winner”) will be determined via a random drawing for the prize (defined in Section 5, below). The drawing will take place on Monday, October 17, 2022, by 11:59 p.m. PST. Ooma Business will tag the potential winning entrant in a comment in the promotional post on Facebook within 48 hours after the drawing. The potential winning entrant must successfully reply to Sponsor within 48 hours after being tagged in the promotional post on Facebook to be selected as the Winner, or Sponsor may elect to award the prize to the next eligible winning entrant. If Sponsor is unable to successfully contact or communicate with a potential winning entrant, Sponsor may elect to award the prize to the next eligible winning entrant(s). No more than three potentially winning entrants will be contacted, after which the prize will remain un-awarded.
Prize: One Winner will receive a $100 Amazon gift card.
Taxes: ALL FEDERAL, STATE, AND LOCAL TAXES, INCLUDING INCOME TAX, ARE SOLELY THE RESPONSIBILITY OF THE WINNER. Any difference between the stated estimated value of the prize and its actual value will not be awarded. Winner agrees to accept the prize “as is.”
Odds of Winning: The odds of winning will depend on the number of eligible entries during the Sweepstakes Period.
Donation: During the Sweepstakes Period, Ooma, Inc. will make a $1 donation for each Like on its Hispanic Heritage Month promotional post on Facebook to the following non-profit organization: United States Hispanic Chamber of Commerce (“USHCC”), with a maximum donation of $1,000. Information concerning the organization may be obtained at their website: https://www.ushcc.com. In the event USHCC is legally unable to accept, or declines to accept, a donation from Sponsor, the donation will be donated to a similar non-profit organization, as determined by Sponsor in its sole discretion.
Prize Restrictions: The prize is nonrefundable and nontransferable. Sponsor is not required, but has discretion to offer substitutions, a cash redemption or alternative to a prize awarded under this Sweepstakes. Sponsor reserves the right to substitute a prize of equal or greater value if a prize is unavailable.
General Entry Rules: Any entrant who attempts or otherwise encourages others to manipulate or create multiple entries will be disqualified. Sponsor reserves the right to take any and all measures it deems necessary to ensure a fair Sweepstakes. Incomplete entries are ineligible, disqualified and void. Sponsor is not responsible for circumstances that may limit or otherwise restrict the ability to participate including, but not limited to: (i) late or incomplete entries; (ii) errors that occur in Winner notification or other Sweepstakes-related communications; (iii) or for any posting errors in these official rules.
Limitation of Liability: By entering this Sweepstakes, entrants waive all right to, and hold Sponsor and Facebook harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this Sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Sponsor and Facebook will not be responsible for: late, incomplete, or incorrect entries; an entrant’s failure to receive prize notices due to entrant’s spam, junk e-mail, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; by any human error which may occur in the processing of the entries in this Sweepstakes; or any typographical, technological, or other error in the publishing of the Sweepstakes, administration of the Sweepstakes, or announcement of the prize. Sponsor reserves the right to, in its sole discretion, cancel or modify this Sweepstakes in a manner deemed appropriate by Sponsor. In the event of termination, Sponsor may still select a potentially winning entrant from among all eligible entries received as of date of termination. If for any reason the Sweepstakes cannot be conducted as described in these official rules, including but not limited to due to an error, or if there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the Sweepstakes, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify, or suspend this Sweepstakes and select a potentially winning entrant from entries received or as otherwise deemed fair and appropriate by Sponsor.
Release: By entering, entrants and the Winner agree to be bound by these official rules and agree that Sponsor, its subsidiaries, affiliates, advertising and promotion agencies, successors, and assigns, may use (unless prohibited by law) Winner’s Facebook post, name, likeness, image, photograph, voice, city/state of residence, biographical information and the prize for advertising, trade and promotion in any media or format, including social media without further compensation, permission or notification, except where prohibited by law. Winner may be required to sign and return to Sponsor an Affidavit of Eligibility and Publicity/Liability Release or the prize may be forfeited and awarded to an alternate.
CA Section 1542: Entrants expressly waives the provisions of Section 1542 of the California Civil Code and any other statutes, rules, laws, ordinances, or common law principles or other authority of any jurisdiction, and further waives any right to invoke said provisions now or in the future with regard to the Sweepstakes. Entrants and Winner further acknowledge and agree that this waiver is an essential and material term of these official rules and the Sweepstakes.
Governing Law: Except to the extent pre-empted by federal or other applicable state law, the Sweepstakes shall be governed by the laws of the State of California, without giving effect to any conflict of law provisions thereof. Entrants understand and agree that all claims, disputes or controversies between entrant and the Sweepstakes Entities shall be resolved by final and binding arbitration in the County of Santa Clara, State of California. By entering, entrants voluntarily and knowingly waive any right they have to a jury trial.
