Ooma’s Pride Month Sweepstakes Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

Eligibility: The sweepstakes is open to legal residents of the United States including the District of Columbia who are 18 years of age or older at time of entry. Employees of Ooma, Inc (“Sponsor”) and their immediate family members (parents, siblings, children and spouse, and any person residing in the same household whether related or not), its affiliated companies and subsidiaries, and their advertising and promotion agencies associated with Ooma’s Pride Month Sweepstakes ( “Sweepstakes”) are not eligible to enter or win.
Sweepstakes Period: The Sweepstakes begins at 9:00 a.m. PDT on Wednesday, June 1, 2022, and ends at 8:30 p.m. PDT on Thursday, June 30, 2022 (the “Sweepstakes Period”). Sponsor or its duly authorized representative shall determine of all Sweepstakes-related time periods.
How to Enter: During the Sweepstakes Period, you can enter for free by visiting Sponsor’s Facebook page at https://www.facebook.com/oomainc, locating the Pride Month promotional post, and leaving a rainbow emoji in the comments. You will be asked to provide basic contact information, including your first name, last name, and email address. Receipt of entry will not be acknowledged. Alternatively, you can enter by mailing a written request to Sponsor at the address below. Any mailed entries must be received by Sponsor before the end of the Sweepstakes Period.
Limit of one (1) entry per person.
How to Win: One winner ( “Winner”) will be determined by a random drawing for the Prize (as defined in Section 5 below) on or about Thursday, July 1, 2022. The potential Winners will be notified by Facebook comment within approximately forty-eight (48) hours following the drawing. Sponsor will reply to entrant’s comment made on the Pride Month promotional post and not directly to the entrant. Upon receiving notification, Winner must successfully reply to Sponsor or its representative within forty-eight (48) hours following notification, or Sponsor may award the prize to the next eligible entrant. In the event Sponsor or its designee is unable to successfully communicate with a potential Winner, Sponsor may award the prize to the next eligible entrant(s) until such time a Winner is determined.
Prize: One Winner will receive a $100 Amazon gift card. Any difference between the stated estimated value of the prize and its actual value will not be awarded.
ALL FEDERAL, STATE, AND LOCAL TAXES, INCLUDING INCOME TAX, ARE SOLELY THE RESPONSIBILITY OF THE WINNER.
Odds of winning: The odds of winning will depend on the number of eligible entries during the Sweepstakes Period.
Donation: Beginning June 1, 2022 at 9:00 a.m. PST and ending on June 31, 2022 at 8:30 p.m. PDT, Sponsor will make a $1 donation for each Like on its Pride Month Facebook post to the non-profit organization LGBT National Help Center, with a maximum donation of $1,000. Information concerning the organization may be obtained at its website: LGBT National Help Center. In the event this organization is legally unable to accept, or declines to accept, a donation from Sponsor, the donation will be made to other organizations as determined by Sponsor.
Prize Restrictions: The Prizes are nonrefundable and nontransferable. Sponsor is not required, but has discretion to offer substitutions, a cash redemption or alternative to a prize awarded under this Sweepstakes. Sponsor reserves the right to substitute a prize of equal or greater value if a prize is unavailable.
General Entry Rules: Any entrant who attempts or otherwise encourages others to manipulate or create multiple entries or acts in violation of these Official Rules will be disqualified. Any attempt by any person to tamper with the Sponsor’s Facebook page or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law. Should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies to the fullest extent permitted by law. Sponsor reserves the right to take any and all measures it deems necessary to ensure a fair Sweepstakes. Incomplete entries are ineligible, disqualified and void. Sponsor is not responsible for circumstances that may limit or otherwise restrict the ability to participate including, but not limited to: (i) late or incomplete entries; (ii) errors that occur in Winner notification or other Sweepstakes-related communications; (iii) or for any posting errors in these Official Rules. If an error results in more prizes being claimed than the number stated in these Official Rules, those entrants will be included in a random drawing to award the advertised number of prizes available.
If for any reason the Sweepstakes cannot be conducted as described in these Official Rules, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes and select the Winner from entries received or as otherwise deemed fair and appropriate by Sponsor.
Release: By entering, entrants and the Winner agree to be bound by these Official Rules and agree that Sponsor, its subsidiaries, affiliates, advertising and promotion agencies, successors, and assigns, may use Winner’s Facebook post, name, likeness, image, photograph, voice, city/state of residence, biographical information and the prize for advertising, trade and promotion in any media or format, including social media without further compensation, permission or notification, except where prohibited by law. Winner may be required to sign and return to Sponsor an Affidavit of Eligibility and Publicity/Liability Release or the prize may be forfeited and awarded to an alternate.
Entrants expressly waives the provisions of Section 1542 of the California Civil Code and any other statutes, rules, laws, ordinances, or common law principles or other authority of any jurisdiction, and further waives any right to invoke said provisions now or in the future with regard to the Sweepstakes. Entrants and Winner further acknowledge and agree that this waiver is an essential and material term of these Official Rules and the Sweepstakes.
Governing Law: Except to the extent pre-empted by federal or other applicable state law, the Sweepstakes shall be governed by the laws of the State of California, without giving effect to any conflict of law provisions thereof. Entrants understand and agree that all claims, disputes or controversies between entrant and the Sweepstakes Entities shall be resolved by final and binding arbitration in the County of Santa Clara, State of California. By entering, entrants voluntarily and knowingly waive any right they have to a jury trial.
Winner List and Official Rules: Individuals may request a copy of the official rules and/or name of the Winner by sending a self-addressed envelope by August 1, 2022, to: Ooma, Inc., 525 Almanor Avenue, Suite 200, Sunnyvale, CA 94085, Attn: Ooma’s Pride Month Giveaway.
Privacy Policy: Personal information provided by Entrants to enter the Sweepstakes is subject to Sponsor’s Privacy Policy which can be found at https://www.ooma.com/legal/privacy-policy/.
Failure by the Sponsor to enforce any provision of the Official Rules shall not constitute a waiver of that provision.
Sponsor: The Sponsor of the sweepstakes is Ooma, Inc., headquartered at 525 Almanor Avenue, Suite 200, Sunnyvale, CA 94085. The Sweepstakes is in no way sponsored, endorsed, administered by or associated with Facebook or organization receiving the donation from Sponsor.
